In these terms & conditions references to 'Bejant', 'we', 'us', 'our' and any similar expression shall be deemed to refer to the Company. The terms 'You' and 'User' as used herein refer to all individuals and/or entities accessing this website for any reason.

These terms and conditions ("Terms and Conditions") relate to your use of the Website. Other terms may apply to the provision of services that Bejant provides via this Website or other means and You should check to see what specific terms and conditions apply to each Bejant service. Eligibility to use the Website

By using the Bejant Website, You represent and warrant that (a) all registration information You submit is truthful and accurate; (b) You will maintain the accuracy of such information; (c) You are 16 years of age or older; and (d) your use of the Bejant website does not violate any applicable law or regulation. We may delete your profile if we believe that any information is incorrect or inaccurate.

  • Using the CV database for any purpose other than as an employer seeking employees for specific live jobs including, but not limited to, using the information in the CV database to sell or promote any products or services or to source people to join a franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity requires an up front or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub—distributors or sub—agents.
  • Using the database for any purpose other than as a student identifying contacts to exchange feedback, career and interview advice and CV preparation.
  • Using the CV database for any purpose other than as an educator/university to identify candidates for courses or graduate and further education programmes.
  • Using the CV database for any purpose other than as a recruitment agency to identify potential candidates.
  • Sending unsolicited mail or e—mail, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services to a user of the Website.
  • Deleting or revising any material posted by any other person or entity.
  • Using any device, software or routine to interfere or attempt to interfere with the proper working of Website or any activity being conducted on this Website.
  • If You have a password allowing access to a non—public area of this Website, disclosing to or sharing your password with any third parties or using your password for any unauthorised purpose.
  • Notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other device or mechanism including, without limitation, browsers, spiders, robots, avatars or intelligent agents to navigate or search the Website other than the search engine and search agents available from us and other than generally available third party web browsers.
  • Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Website.

  • Framing of or linking to any of the Web Site Content or information available from the Website.
  • Posting jobs which require the applicant to provide information relation to his/her (i) racial or ethnic origin (ii) political beliefs (iii) philosophical or religious beliefs (iv) membership of a trade union (v) physical or mental health (vi) sexual life (vii) the commission of criminal offences or proceedings or (vii) age.

You are not allowed to post content that, in the sole discretion of Bejant:

  • is offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
  • harasses or advocates harassment of another person;
  • exploits people in a sexual or violent manner;
  • contains nudity, violence, or offensive subject matter or contains a link to an adult website;
  • solicits personal information from anyone under 18;
  • provides any telephone numbers, street addresses, last names, URLs or email addresses;
  • promotes information that You know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
  • promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture—installed copy—protect devices;
  • involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";

  • covering or obscuring the banner advertisements on your personal profile page, or any Website page via HTML/CSS or any other means;
  • any automated use of the system, such as using scripts to add friends or send comments or messages;
  • interfering with, disrupting, or creating an undue burden on the Services or the networks or services connected to the Services;
  • attempting to impersonate another User or person;

You acknowledge that any reliance on material posted by other users will be at your own risk. We are under no legal obligation to, and generally do not, control the information provided by other users which is made available through the Website. We have no obligation to screen communications or information in advance and we are not responsible for screening or monitoring material posted by users. If notified by a user of communications which allegedly do not conform to these Terms and Conditions, we may investigate the allegation and determine in good faith and at our sole discretion whether to remove or request the removal of the communication. We have no liability or responsibility to users for performance or non—performance of such activities. We reserve the right to terminate users and prevent their further access to the Website for violating the Terms and Conditions or the law and the right to remove communications which are abusive, illegal or disruptive. We may take any action with respect to user—submitted information that we deem necessary or appropriate in our sole discretion if we believe it may create liability for us.

Liability

The Website is only a venue for employers, educator/university and recruitment agencies to post job opportunities and candidates to post CV's and does not screen or censor the listings offered. We are not involved in the actual transaction between employers, educators/universities or recruitment agencies and candidates. As a result, we have no control over the quality, safety or legality of the jobs, courses, education programmes or CV's posted, the truth or accuracy of the listings, the ability of employers or recruitment agencies to offer job opportunities to candidates, the ability of educators/universities to offer the courses or education programmes to candidates or the ability of candidates to fill job openings or attend courses or education programmes. In addition, note that there are risks including, but not limited to, the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom You come in contact through the Website.

We cannot and do not confirm that each User is who they claim to be. As we do not and cannot be involved in user—to—user dealings or control the behaviour of participants on the Website, in the event that You have a dispute with one or more users, You release us (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. You are solely responsible for your interactions with other Users. We reserve the right, but have no obligation, to monitor disputes between You and other Users.

We are not to be considered to be an employer, recruitment agency or educator/university with respect to your use of the Website and we shall not be responsible for any employment or educative decisions, for whatever reason made, made by any entity posting jobs or courses on the Website.

BEJANT DOES NOT WARRANT THAT THE WEBSITE WILL OPERATE ERROR—FREE OR THAT THE WEBSITE AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE WEBSITE OR THE WEBSITE CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, WE ARE NOT RESPONSIBLE FOR THOSE COSTS.

This agreement is governed by the laws of England and Wales.

The courts of England and Wales have non—exclusive jurisdiction.

The Contracts (Rights of Third Parties) Act does not apply to these terms and conditions.

These terms and conditions constitute the entire and only agreement between the parties with regards to its subject matter and each party confirms that it has not been induced to enter into this agreement in reliance upon, nor has it been given, any warranty (including in particular any warranty as to merchantability, fitness for purpose or uninterrupted functionality), representation, statement, assurance, covenant, agreement, undertaking, indemnity or commitment of any nature whatsoever other than as are expressly set out in this agreement and, to the extent that it has been, it unconditionally and irrevocably waives any claims, rights or remedies which it might otherwise have had in relation thereto.

No failure or delay by a party to exercise any of its rights under this agreement shall operate as a waiver thereof and no single or partial exercise of any such right shall prevent any other or further exercise of that or any other right.

In the event that any provision of these terms and conditions is deemed by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced in line with the intention of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.

You may not assign any part of this agreement but Bejant may assign this agreement to its subsidiaries or holding companies without notice to you.



Bejant policy on intellectual property rights

This policy statement sets out the manner in which Bejant Limited and its associated companies ("Bejant") deals with its intellectual property rights ("IPR"), including how it obtains, exploits and enforces IPR.

As a highly innovative technology company, Bejant invests significant amounts of engineering and financial resources in developing its technology and believes in aggressively procuring, exploiting and, where necessary, enforcing its IPR. Bejant believes its IP Policy provides freedom to operate and will permit it to continue to business in the field it leads.

Bejant's technology has significant market and technical advantages which are protected by its IPR and the company is committed to preserving and enhancing its competitive position through its strategic IPR portfolio management, including taking offensive and/or defensive legal action, as necessary. This policy is indicative only and Bejant reserves the right to take such actions and/or assert its intellectual property rights as it sees fit without prior notice.

IP rights are critical to our technology offering

Bejant deals with all types of intellectual property. Significantly, Bejant as filed a patents application relating for example to our innovations in the graduate recruitment space. Bejant is also the owner of further IPR which protect its service offering, software, trading style, technologies and other valuable business assets including but not limited to trade mark rights, rights in passing off and unfair competition, trade secrets, database rights, design rights and copyrights.

Enforcement

Unauthorised use of Bejant's IPR damages not only Bejant and its partners but the industry as a whole. The company does not tolerate unauthorised infringements of its IPR and will pursue infringers to obtain resolution and if necessary formal remedies and relief to the fullest extent possible, including injunctions, damages (and exemplary or enhanced damages if applicable) or an account of the infringers profits, and enforcement costs. Bejant continually monitors and reviews potentially infringing activities and has financial provision and management approval for taking legal action internationally, without notice if necessary.

Licensing

Under certain circumstances, Bejant may be willing to enter into licensing arrangements to allow third parties to use its IPR. Bejant only grants licences in writing and each licence is subject to formally agreed terms and conditions. Nothing in this policy statement should be regarded as a waiver of any right or an offer of a licence and each instance will be treated on its own merits. Please contact Jojar S. Third Party Rights

In certain circumstances, Bejant's processes may involve the use of third party IPR. It is Bejant's policy to respect third party IPR an not to knowingly infringe any such IPR. The Company believes it has taken appropriate steps to minimise the risk of infringing third party IPR. If a third party is aware of any of their IPR being used in an unauthorised manner in connection with Bejant's business, they are requested to contact Jojar S. Dhinsa, CEO or Sue Loveluck, COO, who will investigate the situation and reserves the right to unilaterally suspend relevant activities, if necessary.

Confidential Information

Information disclosed on securely accessible parts of Bejant's website may include, but is not be limited to, that relating to or connected with products, operations, processing, developments, trade secrets, know—how, employees, officers, customers or clients, suppliers, plans, intentions, market opportunities, business affairs, memos, reports, interpretations and records or other information in whatever form which concerns Bejant's business and affairs and is of a confidential nature ("Confidential Information").

If you are granted secure access, you can use the Confidential Information for the purpose that has been agreed with Bejant for such use, provided that you keep in confidence any Confidential Information accessed on the Bejant website and do disclose any such Confidential Information to any person (other than employees or professional advisers, who need to know the Confidential Information and are informed by you that it is Confidential Information) without the written consent of Bejant. Confidential Information excludes any information which has been published other than through a breach of this policy and information obtained from a third party who is free to disclose it.

Providing additional information beyond what is required at registration is at your discretion, but allows you to better identify yourself and interface more effectively with the Bejant community. Please note that once supplied certain information will by default be accesible by non-registered users of the Bejant site. Governing Law

This policy is governed by the Law of England and Wales. Any disputes arising from or in connection with this Policy shall be subject to the exclusive jurisdiction of the English Courts.
